Traditional Negotiations and Interest-Based Bargaining
Many models of negotiations can be utilized to reach agreement between opposing parties. A common method familiar to all is the traditional model of an offer followed by counter-offers to reach an agreement. Richard N. Lyons, II and Adele Reester have assisted our clients in reaching agreements with firefighter unions, teacher associations, and other individuals through the traditional negotiation process.
Where there are long-standing relationships or common interests between the parties, the use of interest-based bargaining may be the negotiation model to employ in order to reach your agreement. Also known as IBB, interest-based bargaining allows parties to reach agreements that the parties can feel good about and that serve to strengthen the organization overall. The IBB process can easily be employed by public entities to reach agreements with firefighter or other unions, as well as teacher associations. Richard N. Facilitation and Training
While you might not need an attorney to advise you or your entity’s board or to be on your negotiating team, having a facilitator involved in negotiations can move negotiations forward and reach tentative agreements. A facilitator acts as a neutral party listening to both sides and assisting the negotiation teams to think creatively in order to find solutions that lead to agreement. Consider utilizing a facilitator to help your negotiations reach a successful conclusion.
